 Abstract 

Background. Innovative technologies in medicine enable a person to prolong, improve and change their personal parameters. Technical and medical capabilities are reaching a new level. However, the legal regulation of such processes is currently limited, it does not solve a number of emerging problems. The consideration of this topic seems relevant, as it primarily affects human rights and allows exploring them from a different viewpoint. The present faces their transformation with the view to the development of modern technical means, including in the field of medicine. The aim of the work is to analyze the current legislation of the Russian Federation in this area, to identify the main problems of the guarantee and protection of human rights, to formulate proposals for improving legislation in order to guarantee a person the observance of his/her personal (somatic) rights. Materials and methods. The objectives of the work are achieved through the analysis of legislation, judicial practice and statistical data. In the course of the study, the formal legal method is used, as well as a wide range of general scientific methods that allow summarizing the studied information and drawing conclusions. Results. The problematic aspects in the legal regulation of the cyber-physical systems and certain issues of transplantology are identified. The materials of judicial practice are analyzed. Conclusions. Legal regulation of innovations in the field of medicine, which are introduced into a person’s life and affect his/her personal (somatic) rights, should be proactive in nature. This, in turn, will ensure timely pro-tection of human rights when using the cyber-physical systems and other innovations in the field of medicine.
